This Privacy Policy describes how Stellarys Resonance LLC (“Company,” “we,” “us,” or “our”) collects, uses, and shares information in connection with the Agenarys platform (“Platform”), including our website at agenarys.com and all related AI agent services, tools, and communications.

By using the Platform, you agree to the collection and use of information as described in this policy. If you do not agree, please discontinue use of the Platform.

1. Information We Collect

Information you provide directly: When you create an account, submit a form, or communicate with us, we may collect your name, email address, phone number, business name, business type, billing information, and any messages or content you submit through the Platform.

Information collected through AI agent interactions: When our AI agents operate on your behalf (handling phone calls, emails, SMS, chat, and scheduling), we collect and process the content of those interactions, including call recordings, transcripts, message content, calendar data, and customer contact information, in order to deliver the services you have requested.

Information collected automatically: We collect standard log data including IP addresses, browser type, device information, pages visited, referring URLs, and timestamps. We may use cookies and similar technologies to maintain sessions and improve the Platform experience.

Information from third-party integrations: If you connect CRM systems, calendar tools, email accounts, or other third-party services, we access data from those systems as necessary to configure and operate your AI agents.

2. How We Use Your Information

We use the information we collect to provide, maintain, and improve the Platform and its AI agent services; configure, deploy, and optimize AI agents for your business; process transactions and send related billing communications; communicate with you about your account, service updates, and support requests; generate performance reports and analytics; comply with legal obligations; and detect, prevent, and address fraud, abuse, or technical issues.

3. How We Share Your Information

We do not sell your personal information. We may share information with service providers who assist us in operating the Platform (such as cloud hosting, payment processing, AI model providers, telephony services, and analytics); with your express consent or at your direction; to comply with applicable law, regulation, legal process, or governmental request; to enforce our Terms of Service; and to protect the rights, property, or safety of our company, users, or the public.

AI agent interactions conducted on your behalf may involve transmitting data to third-party AI model providers for processing. This data is used solely to generate responses and is not retained by those providers for training purposes, to the extent permitted by our agreements with them.

4. Data Retention

We retain your information for as long as your account is active or as needed to provide services. Upon account termination, we will delete or anonymize your data within 90 days, except where retention is required by law or necessary to resolve disputes.

5. Data Security

We implement commercially reasonable technical and organizational measures to protect your data, including encryption in transit and at rest, access controls, and regular security assessments. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

6. HIPAA Compliance

For clients on our Sovereign tier who require HIPAA-compliant infrastructure, we offer Business Associate Agreements (BAAs) and implement additional safeguards for protected health information (PHI) as required by applicable law. Please contact us to request a BAA.

7. Your Rights and Choices

Depending on your jurisdiction, you may have the right to access, correct, or delete your personal information; opt out of certain data processing activities; request a copy of your data in a portable format; and withdraw consent where processing is based on consent. 8. Children’s Privacy

The Platform is not directed to individuals under the age of 18, and we do not knowingly collect personal information from children. If we learn we have collected information from a child, we will delete it promptly.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Platform with a revised effective date. Your continued use of the Platform after changes are posted constitutes acceptance of the updated policy.
